Changes in legislation become effective in 120 days; Measures will benefit the employee and give more security to employers
The law that modernizes the Consolidation of Labor Laws was published in the Official Gazette this Friday (14), one day after President Michel Temer, to sanction it without vetoes. The changes take effect in 120 days.
"This bill is the synthesis of how this government acts. As I have said, dialogue is essential, but also social responsibility. We are preserving all the rights of the workers. The Federal Constitution so determines. "
One of the main points of the text is what provides that collective bargaining agreements have the force of law. "In the Constitution, as a right of the workers, collective bargaining agreements and collective bargaining agreements [...] So, what was done was to regulate the constitutional provision that, let's face it, took almost 30 years to be regulated," said Temer By sanctioning the text.
Among the points that will benefit the workers are what allow the slicing of vacations in up to three times and what regulates the work of home, called home office.
The law also creates safeguards for the outsourced worker, such as an 18-month quarantine to prevent the company from dismissing the actual worker to rehire him as an outsourcer. The employer who maintains an unregistered employee will pay a fine of R $ 3,000 per employee.
The government's expectation is that the new law will improve working conditions in Brazil and generate more jobs.
