Labor Inspection recovers in four months more than R $ 2 billion not collected from FGTS

In the first four months of 2019, the Secretariat for Labor Inspection (SIT) of the Ministry of Economy recovered R $ 2.06 billion to the FGTS. The result is 35.81% higher than in the same period of 2018, when the amount recovered was R $ 1.51 billion.

The amounts collected between January and April are mainly the result of supervisory actions carried out by labor auditors in companies that fail to deposit the amounts owed in the linked accounts of their employees. In 2018, R $ 5.23 billion were recovered, a 23.6% increase compared to 2017 (R $ 4.23 billion). The volume collected in 2016 reached R $ 3.1 billion, while in 2015 it was R $ 2.2 billion.

The largest recoveries recorded in the first four months of 2019 occurred in the states of São Paulo (R $ 323 million), Rio de Janeiro (R $ 178 million), Rio Grande do Sul (R $ 116 million) and Minas Gerais (R $ 115 million ).

How to track deposits - Workers can track whether the employer is making FGTS deposits through the Caixa website or they can register to receive deposit information through SMS (on the cell phone). If you check the lack of deposits, the employee can file a complaint in the units of the Secretariat of Social Security and Labor of the Ministry of Economy and / or file with the Labor Court.

From November 2019, by decision of the Federal Supreme Court (STF), the FGTS prescription, applicable for the collection of contributions not deposited by employers and service takers, will now be five years. This means that, from then on, the employee will only be able to charge in court the amounts of FGTS not deposited by the employer in the last five years.

In this sense, the FGTS inspection actions were intensified. "We are prioritizing companies with indications of old debts, in order to guarantee workers' rights and preserve the integrity of this fund of fundamental importance for Brazilians," says the head of the FGTS Inspection Division, Jefferson Labor Auditor of Morais Toledo.

According to Jefferson, the Labor Inspectorate has promoted the constant training of its employees and the improvement of the FGTS inspection systems, which has allowed a better monitoring of the debts and a greater effectiveness in its collection.
