The plenary of the Chamber of Deputies concluded, last Friday (12/7), after analyzing agglutinative amendments and highlights, the vote in the first round of Proposed Amendment to the Constitution (PEC) 06/2019 - that of Nova Previdência. With the approval, the next step will be the second round vote in the Chamber, scheduled for the beginning of August, after the parliamentary recess.

 The base text of the SGP had already been approved in the first round on Wednesday (10/7) by 379 votes in favor and 131 against. The agglutinative amendments and highlights presented by party polls to change the base text were voted between Thursday (11/7) and Friday (12/7). Agglutinative amendments 5 (DEM) and 8 (PODE) and highlights 76 (PSB) and 44 (PDT) were approved, producing the following changes in the PEC:


The minimum period of contribution for the retirement of women in the General Social Security System (RGPS), from 20 years to 15 years, was reduced. With this change, the floor of 60% in the amount of retirement will be considered at 15 years, with 2% for each additional year, allowing the woman to have a benefit in the amount of 100% of the average salary with 35 years of contribution.


The minimum contribution time for men's retirement in the RGPS was also reduced from 20 years to 15 years. One difference with respect to women is that, in the case of men, the decrease will only apply to men who are already working when the New Pension comes into force. Thus, men who enter the labor market after the term of the New Pension Plan must contribute for at least 20 years to be entitled to retirement. Another difference is that, for men, the increase of 2% will only be counted for each year that exceeds 20 years of contribution, making the benefit of 100% of the average salary reach 40 years of contribution.


 For teachers of basic education (elementary education, elementary and high school) in the effective exercise of teaching, the minimum age for retirement was reduced in one of the rules of transition. In the case of men, it fell from 58 years to 55 years. In the case of women, from 55 years to 52 years. It will be necessary, however, to pay a "toll" equivalent to the time remaining to reach the minimum contribution time on the date of publication of the future constitutional amendment. Example: A teacher who is one year old to retire will have to work two years before being entitled to retirement.

Public security

The minimum retirement age for federal police, federal highway police, federal legislative police, civilian police of the Federal District, federal prison agents and federal socio-educational agents was reduced by the transition rule to 52 years (women) and 53 years (men), since which complies with "toll" equivalent to the time remaining to reach the minimum contribution time on the date of publication of the future constitutional amendment. In the case of women, 25 years of contribution will be required and 15 years in the exercise of police activity. In the case of men, 30 years of contribution and 20 years in the exercise of police activity. Example: A federal police officer who is one year old to retire, will have to work two years before being entitled to retirement.


The death pension can not be less than a minimum wage if the beneficiary of the pension has no other formal source of income.

The approval of a PEC requires a two-shift vote in the House and Senate. After the vote in the second round in the House, the proposal goes to the Senate, for consideration by the Constitution and Justice Commission (CCJ). Then he goes to the plenary. The last step is the promulgation of the constitutional amendment by the National Congress, when the new text is inscribed in the Federal Constitution.
