Combating fraud in the INSS: sanctioned law that reviews social security benefits

"Our first action is to combat fraud," said President Jair Bolsonaro

The President of the Republic, Jair Bolsonaro, sanctioned on Tuesday (18) Provisional Measure 871, which amends and revises the granting of social security benefits, such as incarceration, death pension, among other rights of the insured of the National Institute of Social Security (INSS). The changes envisaged in the new legislation are part of the New Pension Plan, which provides for a number of changes in the pension and pension system.

According to the president, approximately R $ 9.8 billion will be saved over the next 12 months in the fight against irregularities. "Before you start pension reform is to fight fraud. We know, fraud is widespread," he said. 

According to the Special Secretary of Social Security and Labor of the Ministry of Economy, Rogério Marinho, the new rules give greater transparency and security to the INSS, avoiding fraud and correcting distortions in granting benefits. "The law toughens the fight against evacuees, removes vacuums that existed and allows the INSS to remain intact to protect the society it needs," he said during a sanctioning ceremony of the measure in the Planalto Palace.

"We are establishing a process that, over the next two years, will allow almost six million stalled cases in the INSS to be audited by medical experts, by INSS technicians. Of these cases, 30% have indications of irregularities," he said. Marine.

Deprivation aid:  Benefit paid to dependents (children, stepchildren, spouses, parents and siblings) of prisoners, the detention allowance will be shortened by 24 contributions. Currently, it is enough that the insured made a single contribution, before being taken to prison, so that their dependents can be contemplated. 

The benefit will only be granted to dependents of prisoners in a closed regime and no longer in the semi-open, as occurred before the publication of MP 871. The proof of low income will take into account the average of the last 12 salaries of the insured and not only the last one month before the arrest. The accumulation of the seclusion aid with other benefits shall be prohibited. 

Death Pension -  The law requires documentary evidence to prove relationships of stable union or economic dependence, which entitlement to death pension. Currently, the Justice recognizes relations of this type based only on testimonial evidence. 

For the receipt from the date of death, children under 16 years of age will need to apply for the benefit within 180 days after the death of the insured. Under the current rule, this term does not exist for purposes of retroactivity involving children under 16 years. These adjustments will also apply to the Federal Social Security System (RPPS).
